Acceptance of conditions

Each User acknowledges having read all of the Terms and Conditions and the User Terms and Conditions and expressly accepts them without reservation.

Terms and conditions for in-application purchases and subscriptions

Scope of application of these conditions

By purchasing an in-app purchase or a subscription to one of Spark Games' mobile games, you agree that you are submitting a legally binding offer to enter into a contract and acknowledge that you have the legal capacity to enter into such a contract or that you have the permission of your parent or legal guardian to enter into this legal contract.

Please note that use of Spark Games mobile games downloaded through the Apple AppStore is subject to Apple's End User License Agreement.

Acquire subscriptions or in-app purchases from Apple or Google

Subscriptions and in-app purchases are purchased and billed by Apple AppStore or Google PlayStore and not by Spark Games. These purchases are subject to Apple's or Google's terms and conditions. Spark Games does not have access to user accounts or transactions. If you wish to confirm the type of subscription purchased on these platforms, please refer to your account or receipt, as each subscription will have a unique billing name.

In-game purchases on mobile devices use the payment method you have registered with the Apple App Store or the Google Play account registered on your device. For more information, please refer to the Apple or Google support articles.

  • No Ads: In App Purchase - In most Spark Games mobile games it is possible for users to purchase a feature called "No Ads". It is expressly stated that this feature is intended to stop the display of all advertisements that may interrupt our users' gaming experience.

    Please note that this feature does not affect the ability of all players to benefit from additional bonuses that can be unlocked by watching "reward videos" between levels or games. These "reward videos" are videos that players can choose to watch to get something (e.g. double their points, get more gems, new skins or avatars, etc.). Since it is the users' choice whether or not to watch these videos, the "ad-free" feature does not prevent users who have paid to do so in order to get more in-game items and bonuses.
  • Auto-renewing subscriptions - In some of its mobile games, Spark Games offers its users the possibility to purchase a weekly or monthly subscription for a fixed price indicated in that application in order to access specific services expressly made available by Spark Games for their use.

    Users will be charged the renewal fee within 24 hours prior to the end of the current period.

    You agree that the price with respect to the subscribed services is final and shall not be subject to refund by Spark Games.

Termination of subscription

Termination by the user

Subscriptions are managed through the Apple AppStore or Google Playstore:

  • Most subscriptions automatically renew unless you cancel them.
  • If you cancel, you can continue to use the subscription until the next billing date.
  • If you unsubscribe during a trial period, you may lose access to the content immediately.
  • If you have subscribed to a free or discounted trial and do not want to renew it, cancel it at least 24 hours before it ends.

Termination by Spark Games

Except as provided below in connection with subscription renewal, Spark Games may cancel, suspend or terminate your access to subscribed services if:

  • The User is in breach of the conditions.
  • Spark Games is suspicious of any illegal activity associated with the user.
  • Spark Games suspects that certain instances of fraud or misuse have occurred.

The subscription is subject to automatic renewal unless the user unsubscribes 24 hours before the end of the current week corresponding to the subscription period. If the user does not withdraw, the user will be charged for the next subscription period.

The user can directly manage the automatic renewal using the functionality provided in his iTunes Account settings.

General Terms of Service

Effective Date: October 23, 2025

The terms of this agreement ("Terms of Service") govern the relationship between you and NAOLITO GAMES S.L. and its affiliates (hereinafter referred to as "Spark Games", "us", or "we") regarding your use of Spark Games' games, websites, and related services (the "Service"). Use of the Service is also governed by Spark Games's Privacy Policy, which is incorporated herein by reference.

Before accessing or using the Service, including browsing any Spark Games' website or accessing a game, you must agree to these Terms of Service and the Privacy Policy. You may also be required to register an account on the Service (an "Account"). By registering for an Account or otherwise using the Service, you indicate that you are age 13 or older and that you understand and agree to these Terms of Service. If you are between the ages of 13 and 17, you indicate that your legal guardian has reviewed and agreed to these Terms.

If you access the Service from a Social Networking Site ("SNS"), such as Facebook or Google+, you shall comply with its terms of service/use as well as these Terms of Service.

BY INSTALLING, USING, OR OTHERWISE ACCESSING THE SERVICE, YOU AGREE TO THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, PLEASE DO NOT INSTALL, USE, OR OTHERWISE ACCESS THE SERVICE. USE OF THE SERVICE IS VOID WHERE PROHIBITED.

Spark Games reserves the right, at its discretion, to change, modify, add or remove portions of these Terms of Service and its Privacy Policy at any time by posting the amended terms on the Spark Games' Service. You will be deemed to have accepted such changes by continuing to use the Service.

1. LICENSE

1.1 Grant of a Limited License to Use the Service

Subject to your agreement and continuing compliance with these Terms of Service and any other relevant Spark Games's policies, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable limited license subject to the limitations below to access and use the Service for your own non-commercial entertainment purposes. You agree not to use the Service for any other purpose.

The following restrictions apply to the use of the Service:

  • You shall not create an Account or access the Service if you are under the age of 13.
  • You shall restrict use by minors, and you will deny access to children under the age of 13. You accept full responsibility for any unauthorized use of the Service by minors.
  • You shall not sell, rent, or give away your Account, create an Account using a false identity or information, or on behalf of someone other than yourself.
  • You shall not use the Service if you have previously been removed by Spark Games, or previously been banned from playing any Spark Games's game.
  • You shall use your Account only for non-commercial purposes.
  • You shall not use the Service to advertise, solicit, or transmit any commercial advertisements, including chain letters, junk, or spam e-mail or repetitive messages to anyone.

2. OWNERSHIP

All rights, title and interest in and to the Service (including without limitation any games, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, in-game chat transcripts, character profile information, recordings of games played using a Spark Games game client, and the Spark Games game client and server software) are owned by Spark Games or its licensors.

3. DISCLAIMERS; LIMITATION OF LIABILITY

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

IN NO EVENT SHALL SPARK GAMES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF, OR IN CONNECTION WITH, YOUR USE OF THE SERVICE. IN NO EVENT SHALL THE LIABILITY OF SPARK GAMES, WHETHER ARISING IN CONTRACT, TORT, OR OTHERWISE, EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO SPARK GAMES IN THE ONE HUNDRED AND EIGHTY (180) DAYS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM.

4. DISPUTE RESOLUTION AND LAW

If a dispute arises between you and Spark Games, we strongly encourage you to first contact us directly to seek a resolution by contacting us at contact@naolito.com. These Terms of Service and any dispute arising out of or related to it or Privacy Policy or the Service shall be governed in all respects by the laws of Spain, without regard to conflict of law provisions.
