Hello and welcome to Spark Games!

These Terms of Service (the "Terms") govern your use of our mobile applications, games, websites, and related services (collectively, the "Services" or "Games").

These Terms are a legally binding agreement between you and Naolito Games S.L., operating under the commercial name "Spark Games" ("we", "us", or "our"), with registered address at Avenida de Sor Teresa Prat, 15 (Polo de contenidos digitales), 29003, Málaga, Málaga, España and Tax ID B75552836.

By downloading, installing, accessing, or playing any of our Games, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not install or use our Games.

1. Acceptance of Terms and Age Requirements

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Services.

Age requirement: Our Games are intended for users aged 13 and over (or the equivalent minimum legal age in your jurisdiction, such as 16 in certain EU countries). Users under 13 years of age may not use our Services under any circumstances.

Minors between 13 and 18: If you are a minor in your country of residence (for example, under 18 in Spain), you must review these Terms with your parent or legal guardian, who must accept them on your behalf before you may play. Parents and legal guardians who permit a minor to use the Services are responsible for supervising their use and accept these Terms on the minor's behalf.

2. License Grant (How You May Use the Game)

Subject to your compliance with these Terms, Spark Games grants you a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and play our Games solely for your own personal, non-commercial entertainment.

Prohibited Conduct

Any use of the Services that violates the following rules is strictly prohibited and may result in the immediate revocation of your license and the suspension or termination of your account. You agree NOT to:

Hacks and cheating: Use, create, or promote cheats, exploits, bots, hacks, mods, automation software, emulators, or any unauthorized third-party software designed to modify or interfere with the Game or another player's experience.
Account trading: Sell, buy, rent, gift, or otherwise transfer your game account or progress to another person.
Commercial use: Use your account or the Services for any commercial purpose, including advertising, solicitation, or promotion.
Reverse engineering: Decompile, reverse engineer, disassemble, or otherwise attempt to extract the source code of the Games.
Harmful conduct: Use the Game to harass, threaten, abuse, or post offensive, defamatory, obscene, or discriminatory content against any person or group, or to disrupt Spark Games' servers or other users' enjoyment of the Service.
Data collection: Collect, store, or process personal data about other users of the Service for commercial purposes or in any way that violates their privacy or applicable law.
Gambling and betting: Use the Game for gambling, betting, or any similar activity in which prizes or rewards can be won directly or indirectly, regardless of whether a fee or stake is involved.
Security breaches: Probe, scan, or test the vulnerability of our systems, or circumvent any security or authentication measures without authorization.
Malicious content: Transmit or make available through the Services any viruses, malware, or other harmful computer code.
Encouraging violations: Encourage, assist, or facilitate any other person to do any of the above.

3. Your Account and Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you. You agree to:

Not share your account or login credentials with any other person.
Notify us immediately at contact@naolito.com if you become aware of any unauthorized access to or use of your account.
Not create an account using a false identity or on behalf of someone other than yourself.

Spark Games will not be liable for any loss or damage arising from your failure to maintain the security of your account. You acknowledge that you are responsible for any purchases or actions made through your account.

4. Intellectual Property (Ownership)

All rights, title, and interest in and to the Services are the exclusive property of Spark Games. This includes, without limitation:

All computer code, game mechanics, and software.
All artwork, visual design, and characters (including expressly, by way of example, the design of all cats, pets, and board elements in Block Swap and future titles).
Animations, sound effects, music, and user interface (UI) elements.
In-game chat transcripts, character profile information, and recordings of gameplay.

You do not acquire any ownership rights by playing our Games or purchasing virtual goods. You may not use our characters, artwork, or trademarks to create merchandise, derivative works, or commercial content without our prior written authorization.

5. Virtual Goods and In-App Purchases

Our Games may include virtual currency (such as gold coins or gems) and virtual items (such as power-ups, extra lives, or cosmetic elements) that you may purchase with real money ("Virtual Goods").

License, not ownership: When you purchase Virtual Goods, you do not own them. You receive only a limited, personal, non-transferable, and revocable license to use them within the Game. Virtual Goods have no real-world monetary value and cannot be redeemed for real money from Spark Games or any other party.

Final sales: All purchases of Virtual Goods are FINAL AND NON-REFUNDABLE, except where required by applicable law.

App store transactions: Real-money transactions are processed through third-party providers such as Apple (App Store) or Google (Play Store). Spark Games does not directly process payments or your credit card information. Any refund requests must be handled in accordance with the policies of the relevant store platform.

DISCONTINUATION OF SERVICE: IF SPARK GAMES DISCONTINUES ALL OR PART OF THE SERVICES AT ANY TIME, YOUR RIGHT TO USE THE SERVICES OR THE RELEVANT PORTION WILL AUTOMATICALLY TERMINATE. SPARK GAMES SHALL NOT BE REQUIRED TO PROVIDE REFUNDS, BENEFITS, OR OTHER COMPENSATION IN CONNECTION WITH ANY SUCH DISCONTINUED SERVICE, INCLUDING IN RELATION TO ANY VIRTUAL GOODS ASSOCIATED WITH YOUR ACCOUNT.

6. Updates and Modifications to the Service

You understand that the Games are continuously evolving. Spark Games may require you to accept application updates to continue playing. We reserve the right to modify, suspend, rebalance (change difficulty), or discontinue the Services (or any part of them, such as a temporary event) at any time, with or without prior notice.

7. Termination and Suspension of Accounts

Spark Games reserves the right, at its sole discretion and without prior notice, to limit, suspend, or permanently terminate your account and access to the Services if:

You are failing, or Spark Games suspects that you are failing, to comply with these Terms.
You engage in any actual or suspected illegal or improper use of the Services.
Your account has been inactive for 180 consecutive days.

UPON TERMINATION OF YOUR ACCOUNT FOR ANY REASON, YOU MAY LOSE YOUR USERNAME, GAME PROGRESS, AND ANY VIRTUAL GOODS OR BENEFITS ASSOCIATED WITH YOUR ACCOUNT. SPARK GAMES IS UNDER NO OBLIGATION TO COMPENSATE YOU FOR ANY SUCH LOSSES.

You may terminate your account at any time by contacting us at contact@naolito.com or through the account deletion option available in the Game settings (Settings > Privacy > Delete account). You acknowledge that account deletion is irreversible and will result in the permanent loss of all progress and Virtual Goods.

8. Disclaimer of Warranties and Limitation of Liability

OUR GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPARK GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE GAMES. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF GAME PROGRESS, LOSS OF VIRTUAL GOODS, DEVICE FAILURE, OR ACCOUNT TERMINATION.

Nothing in these Terms excludes or limits any rights you may have as a consumer under EU or applicable national law that cannot be limited or excluded by contract, including liability for damages caused by Spark Games' fraud, gross negligence, or willful misconduct.

9. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Spark Games and its officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your use of or access to the Services.
Your violation of these Terms.
Your violation of any third-party right, including intellectual property rights or privacy rights.
Any content you submit or transmit through the Services.

10. Governing Law and Dispute Resolution

These Terms and any dispute arising in connection with them or our Games shall be governed by and interpreted in accordance with the laws of Spain.

As a general rule, any legal proceedings brought against us shall be submitted exclusively to the competent courts of Seville, Spain.

EU consumer rights: Notwithstanding the above, if you are a consumer residing in the European Union, you retain the right to bring proceedings before the courts of your country of residence, in accordance with mandatory EU consumer protection law. You may also access the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

11. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spark Games regarding your use of the Services and supersede all prior agreements, representations, or understandings.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. The updated version will be published on this page with a new "Effective date". If you continue to use the Games after changes have been posted, this means you accept the new Terms. We will notify you of material changes through the Game or through other appropriate channels.
